Seems that since U.N. standards are that anyone fleeing for purposes of Asylum are supposed to request it in the first Country they come too and refuse to do so should lose their right to an Asylum Plea? Mexico is said to have offered Shelter, Food, Work and Medical care to those in the current caravan of people coming out of those Central American Countries plus who knows from where else? But it is also said many in the Caravan have refused this help. So it would seem they have no further right to an Asylum Plea?
They are also supposed to request Asylum at a "Port of Entry" when they get to the first Country where the Asylum Plea is to be made? I do not think that wading, swimming or boating across the Rio Grande and asking a Customs Officer on a River Bank qualifies as a "Port of Entry". So should not be hard to turn them around and send them back to where ever?
Seems the fiasco that is the WV Legislature versus the WVSC is about played out? As noted the two males are going to jail; the three females are going to dinner. It is now pretty much apparent that the State of WV., has at this point little or no control over the actual removal of an errant SC Justice. The feds got the two males. So five people in Black Robes run the State?
Again, there is not a Helluva lot of Law in this State if the "Machine" is involved. No matter if it be to protect itself from the People or from other "Machines" in play?
The Daily Blat is noting the appointment of Ms. Walker as Chief Justice of the WVSC on 1 January 2019 probably should not be much of a surprise. After all, at the moment, she is the only Justice still standing (no pun intended)? Mr. Ketcham and Mr. Loughery in their status as being nailed by the feds are going to jail. Ms. Davis has resigned and has I think been replaced till next Tuesday by Mr. Jenkins? After that, who knows? Mr. Armistad has done the same I believe for Mr. Loughery and again after Tuesday, who knows? Mr. Workman's impeachment trial is in abeyance because the State Legislature is unable to function in its supposedly assigned responsibilities to impeach a WVSC Justice? So that as noted leaves Ms. Walker, who was absolved to become the next WVSC Chief Justice.
Now will the winning Candidate(s), on Tuesday immediately replace the above two Justices? I would think yes anywhere but here? Possibly if one or both of the appointed to complete the current term don't win Tuesday, they may still stay where they are till 1 Jan 2019?
Because of the above, it would not surprise me to see a decision on my case very, very soon in P'burg or left hanging until 1 Jan 2019 Session? Mr. Beane and company may well be waiting to see who may take a position to rule on any case from me that might get there it decided here too soon? One needs to remember, this is NOT about the Law, it is about the still and for decades to come Partisan Politics in our State Judiciary. ALL and I repeat ALL of the people in play have been in the Legal System for decades no matter other sidelines for some in Elected Offices? Each and everyone of them is connected be it innocently or part to the Cabals that have ruled the Judiciary for many years. It is possible albeit not likely that the immediate people in play would automatically vote to dismiss any case coming to them that challenges the local Machine? I for sure am not that naïve'.
Was joking with one running for an Office who was walking around with some money in their hands. Since they were only one dollar bills, I joked with them about buying votes. Said using the old axiom "I am not cheap, but I can be had" line. The person came back and trumped me with apparently the old West Virginia axiom " I can't be bought, but I can be rented" line? Never heard that one before and it is very good and probably very true?
Some days back, I was talking to a City Employee about the proposed Low Income Housing, the Medical Offices and Retail Shops that Mr. Rapp was referring too a week or so back. I noted that anyone renting one of those apartments would get a rude surprise each morning at about 2 or 3 A.M., when that train went through that area sounding its horn? Person said they could always move. Than I noted that they would be inconvenienced to have to move as they did not know about that late night trains? Comment back was they should know to ask about the tracks running by the location? This seems to be more and more the attitude of the City Administration? It is a very good reason to NOT build any kind of living accommodations on that site. In fact, if it listed as an Industrial, Manufacturing, Business site, how could one build apartments which one would think should qualify as "residential" in usage to begin with?
Am pretty sure that Johns Manville will allow it covenants to be removed in order to help the City sell it off, but should still be some safeguards in play? 'nuff said'.
