This is 29B-1-3.(c) of the Freedom of Information Law (knows as a FOIA). The Custodian of any public records (i.e. the Mayor in a City), shall make If the records requested exist in magnetic, electronic or computer form, shall make copies available on magnetic or electronic media, if so requested. (my emphasis),(the person asking for the data).
In Wood County for one location, it is interpreted if the custodian wants to provide to a requestor the records via emails or cd's, so be it. Operative term up above is "wants to provide". (What if one does not have a computer or capability to play a CD. These are not to be found in every home albeit a Cell Phone that can download the emails maybe)?
What it really means is:
If a facility can make magnetic or electronic media (emails, CDs), than the requestor can ask (again, the person ASKING), for that format. Otherwise:
Requestor would accept hard copies such as a letter in the mail providing the required notification on when, where, how much.
And it also by extension allows the requestor to NOT have to accept CDs or Emails if they are not the requested format. That would require a paper/ hard copy response.
As I have said before, I used to be paid to read, interpret and implement Laws, Regulations, Protocols, etc. you name it.
It is very obvious that as stupid/ ignorant the above may appear, it is not the only reason for the faulty interpretations? It can play into arriving at a decision allowing a pre-desired outcome? Could one not easily insert the word "Corrupt" in place of pre-desired?
But the dog and pony show is still playing out as I post this and possibly a real interpretation of the data will be done and the failure of the responders found out?
Some weeks back, I noted that I did not think Mr. Rapp would run for another term? It is to me just as obvious if not more so now that I do not believe he will run again? Why you ask? We start with all the heat on him now for the Johns Manville site; the disaster that he is calling a "budget process" to even the most uneducated observer and finally the probably most true reasons. He is 63 this May; will be 65 in 2020 when his Medicare part A automatically kicks in. Part B could still be deferred to finish the term as Medicare A pays 80% of costs. Part B pays the same and would leave him with a supplemental policy to pay a portion of the rest. Most Supplements pay 80- 90%. But to stay with Highmark as it is today, it would pick up the entire remaining balance so he would have NO obligation to pay anything except his monthly Health Insurance of $0 or $80/ month. He would be at or close to full SSA Pension payments. Let us not even ask about any other monies from any other sources with which he is feathering his nest?
I am going to put the gang on notice that I believe as strongly as I have from the very beginning of the questions on the Incentive/ Retention/ Annuity/ Pension for the VFD Members that is an ILLEGAL use of Tax Dollars? I have one more step to complete what I also believe is a full loop on the Funds Legality? So all seven of the wunderkinds need to understand that voting for the Budget with $45,000., for that Fund in the Current Budgeting year (2018-2019), is probably breaking the Law? I will update once final step is completed. So again and yet again, I would say to Mr. Rapp and his crew "Gotcha". We are looking at a minimum of 13 years for him and how many for Ms. Smith, Mr. Rogers and Mr. Bibbee for approving those monies out of the 18 years the Fund has been funded?
Understand that the rank and file of the VFD are good people; dedicated and well trained. That does not abdicate obeying the Law on payments to them as what they are- VFD guys/ gals.. I would bet $1.00- 2.98, that he is gone.................
Started getting calls Monday evening on Mr. Leach having filed for State Senate. And the emails on Tuesday Morning; very early Tuesday morning. The only advantage of him going to the State Senate is getting him off the City Council- IF and I repeat IF he resigns. Mr. Nohe did not and we were stuck with him through 2011/ 2012. I would fear no less from this guy. Drawback, is the District would be represented by a Progressive Liberal of the worst color. An Elitist who with several members of his family when they addressed Council on the Water/ Sewer Rate Increase were very clear in their what I will ask is contempt for so many of the less fortunate in this City? "Conservative Democrat" says he? There is nothing conservative about him that has shown in the past 13 months?
Whatever the issue, he has been right next to Ms. Smith, Mr. Rapp, Mr. Rogers and usually Mr. Bibbee in a "spend, spend, spend" mentality?
I fear for this Senate Seat in this District, no matter the winner?
In any case, the race for Mayor has the Media at this point appearing to draw up sides- The TV Station for those who remember we have one, seems to have, Mr. Stephens all over segment after segment. The Daily Blat has Mr. Conley with the Photo Ops. Mr. Rapp bringing up the rear which is I would guess is a very fitting place for him?
It can only be stressed again, you folks deserve so much better.
In a bit of a personal note, which I try not to do, I am going to make an exception. To note the passing of Mr. Sylvester Max Wilson. He was no kin to me, but was a fine man who with his Lady were excellent neighbors, kind to a fault. My Wife and I extend our deepest condolences at his passing to her and the rest of his family. Vaya Con Dios, Mr. Max. 'nuff said'.
