Why did it take me so long? Was going into the City Building and the Senior Center to look for the non existent room capacity signs and to do head counts on how many were in the exercise classes for a period of several weeks. The allegations by some of the attendees in the exercise classes of 40- 45 people was never borne out as I never found more than 23 on any day.
And I NEVER got a response from the State on the complaint. The whole issue was like so many issues with Vienna/ Mr. Rapp covered up until AFTER the Election to hide his questionable performance?
In the data, is a response from Mr. Fluty, who is one of or the only one that does Code Inspections in this day and age for the City? As seems to be the case whenever a function that should be connected to the Fire Department as much or more so than Code Enforcement:
1. The alleged appropriate party is not available to respond to the issue due to either illness, vacation, time off, Holiday or just a plain weekend in the mix, or:
2. Any connection to the Fire Department is sluffed off as any records are not available at the FD? And the Fire Chief is unable to figure it out as well as well as one John Knapp who is noted on the City Directory as "Building Inspection" and one would think know about "occupancy limits? This was borne out almost two years ago on the inspections of City Businesses by the Fire Chief or his next in line guy. In fact, in that blow up in 2014, it resulted in the departure from the City employment of the then Code Enforcement guy (Mr. Roush), when it blew up that only 10 businesses had apparently been inspected in 12 months?
In the response to the notice (?) (One of how many missing documents not provided to my FOIA), it was noted that due to illness (see 1 & 2 above), the response was late being responded too (27 Oct 2016). But was received on 4 Oct 2016 after he (Mr. Fluty), returned to work from surgery. It took 23 days to respond to a Complaint Request from the State? But damn close to the Election I would note.
Here is the pertinent part of the letter from Mr. Fluty to the MA&PS office. "I have examined the original 2006 prints (Pickering & Associates Eng, Arch.), for occupant loads. Their calculations are 150 occ., first floor and 80 occ., second floor". Ergo, second floor on that particular day was NOT overloaded while Ms. Kern clearly stated attendees were "in the bathroom and the hall way".
Allow me to comment with a slight bit of common sense on the above occupancy numbers. They are to me nothing more than what could be in the room(s) IF THEY ARE ABSOLUTELY EMPTY. The upstairs has a pool table pushed to one end. There are at least two (2) four or five shelf holders of craft supplies. Than we have the numerous chairs that are sitting out to be used by up to allegedly 40-45 attendees. There is NO WAY on God's Green Earth that room could SAFELY hold 80 people let alone the 60 that caused the brouhaha. Once again, I will allege the TRUTH is left bloodied, battered, beaten and bruised in the ditch as the City lies it A** off. Remember in Vienna, "Public Safety" is spelled Public $AFETY and has been for since 2008 that I am aware of and probably longer?
Then we have the part where Mr. Fluty comments on the new elevator that is ADA compliant. And so, what does that have to do with using it in any sort of a fire situation? One is NOT supposed to use the elevator in a fire. And if one were to look at that oh, so narrow stair well, there is no way that large a group or even the miniscule 12-13 that I have found could get down the stairs safely in an emmergency. More smoke and mirrors it seems? By her own admission, Ms. Kern admitted to having six (6), over 90 years of age that participate and that anyone 55 or up even with "special needs" can be part of the programs. Special needs would include wheelchairs, walkers, canes, crutches and so on. (See above on elevator and stairwell).
What should have happened on that day and any day that the numbers even got close to 40 is that the excess should have been removed for their own safety. Instead on at least that one day, Ms. Kern, Mr. Rapp and Mr. Rogers chose publicity over the seemingly "Public $afety" of yourselves, your mothers, fathers, grandmothers, grandfathers and even disabled relative(s) or friend(s)? The constant use of the elderly in the Senior Center for props/ tools is scary, at least in my thinking?
Where was Code Enforcement or the Fire Chief when that surfaced? Missing in Action as is the case each and everytime a Council Member or Department Head is made aware of any safety issue? All are what I will question very well bought and paid for to remain deaf and dumb as needed?
And in the end, Mr. Fluty made a comment that " musings of the complainant on his current blog or one of the many letters to the editor. I (Mr. Fluty), believe the complainant is aware of the process for the municipality due to more than 140 FOIA's in the past 3 years".
In simple terms, I have found there to be few if any "processes" for the Municipality beyond the usual delay, deny, decline and defer I have experienced for the past three years mixed with generous dosages of deceit, deception, misinformation, misdirection and when the opportunity presents, a lie?
He than promised (my word), to respond to any WVSFMO complaint will be handled in a prompt and professional manner (Right, 23 days and as noted the delay before the Election?).
I took a moment to look up what he meant by "musings"? It came out "thoughtfully abstracted". So I went to "abstracted" to be fair on his writing? " Abstracted"= absent minded. It never ceases to astound me on the incompetent, malfeascent City Administration to attack the messenger? The issue is and will forever be the pursuit by Mr. Rapp for Publicity by any means even as he is doing a wink- wink at the safety of the elderly and infirm or any other issue?
If anyone with any type of mind of their own wish to challenge me on being "absent minded", let us get it on.
And as many of you have asked me why no letters to the editor anymore? For the past two years in
what I have noted before, my letters from publication in the "letters to the Editor" were stopped along with the City Public Forum. Anyone remember the First Amendment?
How would you folks have voted if you had known how little respect/ concern Mr. Rapp seems to have for you, be it Public Safety or the due process of an Election? 'nuff said'.
